Confirmed Train Ticket, No Seat: When Indian Railways Had to Pay Compensation

A confirmed train ticket does not always guarantee access to a reserved seat. Consumer commissions in Bihar and Kerala have ordered railway compensation in cases involving occupied berths and overcrowded coaches.

A confirmed train ticket is supposed to guarantee a reserved berth, allowing passengers to travel without worrying about finding a place to sit. However, there have been cases in which passengers holding confirmed tickets were unable to access their seats, leaving them with no option but to travel standing. In some instances, consumer commissions have held the Railways responsible and ordered compensation for the inconvenience caused.

These cases highlight situations in which passengers may be denied access to their confirmed berths despite having valid reservations. Such incidents have occurred when other people occupy reserved seats, overcrowding prevents passengers from reaching their berths, or a coach is removed from a train for technical reasons.

In May 2026, the Bhojpur District Consumer Commission in Bihar ordered the Railways to compensate passengers in a case involving people who allegedly occupied reserved berths and refused to vacate them.

According to media reports, the case involved the LTT-Patna Express, which runs from Lokmanya Tilak Terminus in Mumbai to Patna. Four passengers had booked confirmed AC 3-tier tickets for travel from Vindhyachal to Ara. When they boarded the train, they found several people occupying their reserved berths. These individuals allegedly claimed to be railway employees.

The passengers attempted to get their seats vacated but were unsuccessful. According to their complaint, they did not receive assistance on the train and were ultimately forced to travel standing.

The commission held the Railways responsible for deficiency in service. It ordered a refund of the ticket fare along with interest, compensation of Rs 20,000 and Rs 15,000 towards litigation expenses.

Overcrowding is another situation in which passengers with confirmed tickets may be unable to use their reserved berths. During festival periods, heavy crowds can make it difficult for passengers to reach their allotted seats, even when they have valid reservations.

In another case that came to light in July 2026, the Palakkad District Consumer Commission in Kerala held the Railways responsible for deficiency in service after passengers faced difficulties accessing their confirmed seats on the Kanniyakumari-Pune Express. The case involved overcrowding in a reserved coach that obstructed passengers' access to their allotted berths.

The commission ordered the Railways to pay Rs 50,000 in compensation and Rs 25,000 towards litigation expenses.

Passengers can also face difficulties when a train coach has to be removed because of technical reasons. In such circumstances, the Railways must make alternative arrangements for passengers booked in that coach. If sufficient space is unavailable, passengers may experience difficulties despite holding confirmed tickets.

A case dating back to 2012 involved an RAC ticket that was converted into a waiting-list ticket. Compensation was subsequently awarded by the court in that case.

Such incidents are relatively uncommon, and the Railways generally provides seats to passengers holding confirmed tickets. However, when passengers are unable to access their reserved berths because of railway-related shortcomings, they can lodge complaints.

Passengers should first approach the Travelling Ticket Examiner (TTE), showing their ticket, coach number and berth number. They can also register complaints through the Railways' official helpline, 139, or the RailMadad platform.

If a passenger is unable to obtain a seat because of a failure on the Railways' part, a refund of the fare may be available. The consumer commission cases underline the importance of ensuring that confirmed reservations translate into access to the allotted seats and that passengers have a means of seeking redress when this does not happen.
